NJ DUI/DWI Penalties

Please read below to learn a little bit about the basic penalties associated with a violation for Driving Under the Influence in the State of New Jersey (N.J.S.A 39:4-50).

First Offense

BAC = .08 or .09 (or no reading)

3 month suspension of driver’s license

$639-789 fines and costs

12-48 hours in the IDRC

Jail up to 30 days

$1000 per year surcharge for 3 years

BAC = .10 or higher (or drugs)

Minimum 7 month suspension of driver’s license

$689-889 fines and costs

12 hours in the IDRC

Jail up to 30 days

$1000 per year surcharge for 3 years

BAC = .15 or higher

All of the above penalties PLUS and ignition interlock device for 6 months – 1 year.


Second Offense

2 YEAR suspension of drivers license

2-90 days jail

30 days community service

$889-1,389 fines and costs

48 hours in the IDRC

Ignition Interlock for 1-3 Years

$1000 per year surcharge for 3 years


Third Offense

180 days in the county jail

10 year suspension of driver’s license

$1389 fines and costs

12 hours IDRC

Ignition Interlock for 1-3 Years

$1500 per year surcharge for 3 years
