New Jersey DUI in a School Zone
As you might imagine, the penalties for Driving While Under the Influence in a school zone are more severe than for a DUI which does not occur in a school zone. The fines are greater for this offense, but perhaps more importantly, the other penalties are much more severe.
For a first offense, it is irrelevant what your BAC was. There are not separate tiers of offenses as there normally are. Instead, if you are convicted of a DUI in a School Zone, for a first offense you face a minimum one year suspension of you license, and it can be suspended for up to two years. Additionally, you can be sentenced up to 60 days in jail, will have to spend 12-48 hours in an Intoxicated Driver's Resource Center, and a court can order you to have an Ignition Interlock device installed for 6 months to 1 years.
For a second offense, your license will be suspended for four years, and you face 96 hours to 180 days in jail. You will also be required to perform 60 days of community service, satisfy the requirements of IDRC, and you will be required to have an Ignition Interlock device installed for 1-3 years.
For a third offense, your license will be suspended for twenty years. Most importantly, you will spend 180 days in jail for a third offense. You will also have to comply with the requirements of IDRC for a third offense and you will be required to have an Ignition Interlock device installed for 1-3 years.
